1. Description of the service and operator
FitBreak is a web and mobile app that reminds you to take breaks during the day and says what you need right now — stretching and exercise, hydration and nutrition, a moment for your head. It includes a personal coach that helps with movement, learning, self-control, focus, sleep, confidence and your own goals. It uses speech synthesis and pre-recorded voices.
The operator and its identification details are given in the last section of these terms.
2. Registration and account
- To use the app you can register with an e-mail address or sign in with a Google account
- The user is responsible for the accuracy of the details given at registration
- Each user may have only one account
- The app is for people aged 15 and over, the subscription and AI coach for people aged 18 and over
3. Price, ads and subscription
- The app and the personal coach are free, with no time limit and no trial
- Running it is paid for by the ads that are displayed
- Two optional services are paid: switching ads off (normally 100 CZK a month or 1,000 CZK a year) and the AI coach (normally 200 CZK a month or 2,000 CZK a year, ad-free included). The prices shown in the app when ordering are binding and final
- The subscription renews automatically for the next period and can be cancelled in the app at any time; it runs until the end of the paid period
- The contract is concluded by paying the order, in Czech or the language of the app. The operator does not keep it as a separate document; the terms in force are always on this page
- Payments are handled by the secure Stripe payment gateway; your payment details never reach us
4. Google Calendar
- Connecting Google Calendar is optional
- The app accesses the calendar strictly in read-only mode
- Calendar data is used only to adapt the breaks
- The user can disconnect the calendar at any time in the settings
5. App content and the coach
- Lines, exercises, programs and coach advice are general suggestions for everyday life
- The app is not a medical device or a health or psychological service. It does not diagnose and does not replace a doctor, therapist or other professional
- If you have pain or health problems, consult a doctor before exercising; exercise within your limits and stop if it hurts
- Results depend on you. The app promises no particular result
6. Availability of the service
- The operator aims for uninterrupted availability but does not guarantee it
- The service may be temporarily unavailable because of maintenance or technical problems
7. Liability
- The operator is liable for proper provision of the service as set by law
- These terms do not exclude liability for harm to health or for damage caused intentionally or by gross negligence, nor consumer rights that cannot be limited by contract
- The operator is not liable for outages of third-party services (Google, Stripe, Azure, OpenAI) it cannot influence
8. Ending the account
- The user may ask for the account and all related data to be deleted
- The operator may close the account of a user who seriously breaches these terms, after prior notice, and refunds the unused part of a paid subscription
9. Changes to the terms
We announce changes at least 30 days in advance in the app or by e-mail. If you disagree, you may end the subscription before the change takes effect and we refund the unused part. A change does not apply to an already paid period to the user's detriment.
10. AI coach
- The AI coach is an artificial intelligence system. Its answers are generated by a machine, not a person
- It drafts a plan from what you write. The draft can be inaccurate, so review it before use
- The subscription includes the monthly number of requests shown in the app. If the service is temporarily down, other features keep working and your plan stays on your device
- Your text is sent to the AI provider only with your consent, details are in the Privacy policy
11. Right of withdrawal
A consumer may withdraw from the subscription without giving a reason within 14 days of concluding it, using the Withdraw from the contract button on the Ad-free page in the app, or by e-mail to the contact below.
- The service starts right away if you expressly ask for it when ordering by ticking the box. Without this request the order does not go through
- On withdrawal the subscription ends and you pay only a proportionate part of the price for the time the service ran. We refund the rest by the original payment method within 14 days at the latest
- You receive confirmation of withdrawal by e-mail
12. Complaints and disputes
- If the paid service does not work as it should, write to the contact below. We handle complaints without undue delay, within 30 days at the latest; rights from defective performance are governed by the Czech Civil Code
- Consumer disputes can be resolved out of court at the Czech Trade Inspection Authority (adr.coi.cz)
- The contract is governed by Czech law. This does not affect the protection given to a consumer by mandatory rules of their country of residence
- Consumer protection is supervised by the Czech Trade Inspection Authority
